<title>City of Tumwater Updating Landscape Codes: Stakeholder Meetings</title>

                                                                <p><span style="font-size: 14px; font-family: Tahoma;">Last Friday, was the first cutoff day of the 2023 legislative session. February 17th is the final day for bills to be passed out of policy committee. The “cutoff” marks the first sifting of the bills from “alive” to “dead” for the rest of the session. The next bill report will look very different as the “dead” bills will be removed from our tracking list. While we await the House and Senate budgets, many other policies of interest are making their way through the process.<br /><br /></span></p>
                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>Transportation</strong><br /><strong>Mileage Tax –&nbsp;<a href="https://app.leg.wa.gov/billsummary/?BillNumber=1832&amp;Year=2023&amp;Initiative=false" target="_blank" style="color: #3498db; font-weight: normal;">HB 1832</a>.&nbsp;</strong>&nbsp;This piece of legislation was a late drop in the session and has been referred to the Transportation committee. The bill is a voluntary road usage charge program that places a per mile fee on motor vehicle usage of public roadways in the state. The target date for implementation of a comprehensive, mandatory road usage charge program is January 1, 2030 within this bill. The road usage charge rate for the voluntary road usage charge program is 2.5 cents per mile. We are opposed to this in its current form without changes to current tax code. Ø<br /><br /><strong>Odometer Bill –&nbsp;<a href="https://app.leg.wa.gov/billsummary/?BillNumber=1736&amp;Year=2023&amp;Initiative=false" target="_blank" style="color: #3498db; font-weight: normal;">HB 1736</a>.&nbsp;</strong>&nbsp;This is another late drop and part of the per mile taxation effort by the legislature. This bill requires the department of licensing to collect vehicle odometer readings at the time of original vehicle registration and registration renewal. Our opinion is this is the starting point of a broader discussion on this for the 2024 short session.<br /><br /><strong>Commercial Drivers Licenses -&nbsp;<a href="https://app.leg.wa.gov/billsummary/?BillNumber=5251&amp;Year=2023&amp;Initiative=false" target="_blank" style="color: #3498db; font-weight: normal;">SB 5251.&nbsp;</a></strong>This is a good bill that we have been publicly supporting to help the authors of the bill get it passed. This bill streamlines the licensing process for a commercial driver's license by allowing the department to waive requirements for applicants that previously surrendered the license, allowing the license to be renewed online, and modifying the license test fees. This bipartisan bill has already cleared policy committee well ahead of the cutoff and is in the Rules committee awaiting a floor vote.<br /></span></p>
                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>&nbsp;</strong></span></p>
                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>Riparian -&nbsp;<a href="https://app.leg.wa.gov/billsummary?BillNumber=1720&amp;Year=2023&amp;Initiative=false" target="_blank" style="color: #3498db; font-weight: normal;">HB 1720.&nbsp;</a>&nbsp;</strong>Last week, the House Agriculture committee voted to move HB 1720 one step closer to passage in the House chamber. This is the volunteer riparian habit development grant program that is a Voluntary Stewardship Program under the State Conservation Commission. This is a bipartisan bill that stemmed from a joint cooperation of the tribes, agriculture, ecology, DNR and other stakeholders. We continue to support this bipartisan bill.<br /></span></p>
                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>&nbsp;</strong></span></p>
                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>Farm Internship -&nbsp;<a href="https://app.leg.wa.gov/billsummary?billnumber=5156&amp;year=2023" target="_blank" style="color: #3498db; font-weight: normal;">SB 5156</a></strong>&nbsp;passed off the Senate Floor earlier in the session. This is a bipartisan bill that extends the farm internship pilot program to all counties. It also removes the expiration of the program and adds a requirement to obtain the special certificate that the interns will perform work that encourages the interns to participate in career and technical education or other educational content with courses in agriculture or related programs at a community or technical college. This is a nice, good faith bill that we hope will result in expanding the agriculture workforce.<br /></span></p>
                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>&nbsp;</strong></span></p>
                                                                <p><span style="font-size: 14px;"><span style="font-size: 14px; font-family: Tahoma;"><strong>Greenhouse Production -&nbsp;<a href="https://app.leg.wa.gov/billsummary?BillNumber=5508&amp;Year=2023&amp;Initiative=false" target="_blank" style="color: #3498db; font-weight: normal;">SB 5508.</a>&nbsp;&nbsp;</strong>Last week the Senate Agriculture Committee heard SB 5508 -promoting local agriculture through greenhouses. The WSNLA publicly supported this bill as it provides that the State Building Code does not apply to any temporary growing structures used solely for the production of horticultural plants. It also establishes that a temporary growing structure is not considered a structure under the State Building Code. This is a no-cost bill with bipartisan support. Unfortunately, this bill was scheduled for a vote on 2/17 but no action was taken.&nbsp;<span style="text-decoration-line: underline;">Based on the cut-off calendar this bill may be done for this legislative session.</span><br /></span>

                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>Pesticide Representative Tom Dent’s<a href="https://app.leg.wa.gov/billsummary/?BillNumber=1019&amp;Year=2023&amp;Initiative=false" target="_blank" style="color: #3498db; font-weight: normal;">&nbsp;HB 1019&nbsp;</a></strong>– Establishing a pesticide advisory board – is still making it’s way through the process with much support. His bill’s intent is to create a formal and permanent advisory board to advise the Washington State Department of Agriculture (Department) on pesticide-related actions that are not considered by the Pesticide Application Safety Committee. We continue to support this bipartisan work.<br /><br /></span></p>
                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>Fuel Tax -&nbsp;</strong>Nearly halfway through the legislative session and we still don’t have answers from the Governor’s office or Ecology regarding the carbon fee fuel cost increase. These increased costs to the end user in 2023 have stemmed from anticipated costs from the new cap-and-invest carbon credit purchase, swap and auction program. The first of these auctions will take place in the second half of February 2023. Negotiations are happening between ecology and cooperative fuel suppliers to figure out an equitable remedy to the problem.</span></p>

                                                                <p><span style="font-size: 14px; font-family: Tahoma;"><strong>Budgets -&nbsp;</strong>The House and Senate budget will be released in the coming weeks as the two bodies face off over how to spend a record $70 billion. The Governor released his $70B budget proposal in December and the two chambers will consider aspects of that proposal with their own to finalize a new two-year budget.</span></p>

<title>Governor Inslee Declares Drought Emergency |  Plant Smart, Water Smarter</title>

<div style="font-family: 'Times New Roman'; font-size: medium;"><span style="font-size: 12px; font-family: Tahoma;"><br />Today, Governor Inslee announced an <a href="https://ecology.wa.gov/DOE/files/40/408b30b3-0d96-4d57-aad8-36e675448b08.pdf" target="_blank">Emergency Drought Declaration</a> that spans nearly the entire state.&nbsp; The only areas excluded from this declaration are the Everett, Seattle and Tacoma metro areas, which are reporting adequate water levels.&nbsp;&nbsp;In advance of this announcement, the Department of Ecology and WSNLA were in communication about potential impacts to&nbsp;<span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">nursery and landscape businesses and regarding the determination of undue hardship due to drought conditions</span>.</span>

<div style="font-family: 'Times New Roman'; font-size: medium;"><span style="font-size: 12px; font-family: Tahoma;">No matter what time of year, drought and water restrictions impact demand for nursery and greenhouse plants.&nbsp; Landscape companies, booked out with jobs, may begin to see reduced demand.&nbsp; Washingtonians with newly installed gardens and landscapes will be concerned about protecting their landscape assets through establishment.&nbsp; WSNLA has communicated that any message that identifies our industry as the first target for water savings is not adequately addressing the conservation of water.</span></div>

When the Washington State Revenue Forecast Council released its recent forecast for the next four years, the prediction was for an additional $860 million available to spend for the next state budget, on top of the billions that were already available when this year’s legislative session began.&nbsp; Budget writers will have a total of $50.6 billion in revenue for the 2019-21 budget cycle.&nbsp;To put that in perspective, in March 2017, budget writers had $41.6 billion to work with.&nbsp;</p>
<p style="margin-bottom: 0.0001pt;">&nbsp;</p>
<p style="margin-bottom: 0.0001pt;">In spite of the rosy revenue forecast, more new tax bills have been introduced.&nbsp; (The Governor’s budget release in December proposed $3.7 billion in new taxes.)&nbsp; Here are a few of the new tax proposals likely to affect you.</p>
<p style="margin-bottom: 0.0001pt;">&nbsp;</p>
<p style="margin-bottom: 0.0001pt;"><b>Property tax</b></p>
<p style="margin-bottom: 0.0001pt;"><a href="http://links.govdelivery.com/track?type=click&amp;enid=ZWFzPTEmbWFpbGluZ2lkPTIwMTkwMzIzLjM2MDg0NzEmbWVzc2FnZWlkPU1EQi1QUkQtQlVMLTIwMTkwMzIzLjM2MDg0NzEmZGF0YWJhc2VpZD0xMDAxJnNlcmlhbD0xNzU5ODE0MiZlbWFpbGlkPWhlYXRoZXJAd2FmcmllbmRzLm9yZyZ1c2VyaWQ9aGVhdGhlckB3YWZyaWVuZHMub3JnJmZsPSZleHRyYT1NdWx0aXZhcmlhdGVJZD0mJiY=&amp;&amp;&amp;104&amp;&amp;&amp;https://app.leg.wa.gov/billsummary?BillNumber=2145&amp;Initiative=false&amp;Year=2019">HB 2145</a> would do away with the 1% annual limit on property-tax growth (approved by the voters through Initiative 747 in 2001) so property taxes can increase at a more rapid rate.</p>

<p style="margin-bottom: 0.0001pt;"><a href="http://links.govdelivery.com/track?type=click&amp;enid=ZWFzPTEmbWFpbGluZ2lkPTIwMTkwMzIzLjM2MDg0NzEmbWVzc2FnZWlkPU1EQi1QUkQtQlVMLTIwMTkwMzIzLjM2MDg0NzEmZGF0YWJhc2VpZD0xMDAxJnNlcmlhbD0xNzU5ODE0MiZlbWFpbGlkPWhlYXRoZXJAd2FmcmllbmRzLm9yZyZ1c2VyaWQ9aGVhdGhlckB3YWZyaWVuZHMub3JnJmZsPSZleHRyYT1NdWx0aXZhcmlhdGVJZD0mJiY=&amp;&amp;&amp;103&amp;&amp;&amp;https://app.leg.wa.gov/billsummary?BillNumber=5991&amp;Initiative=false&amp;Year=2019">SB 5991</a> would increase the tax on real-estate transactions. The revenue it generates would supposedly go toward education, but once revenue is in the general fund, it can be used for anything.</p>

<p style="margin-bottom: 0.0001pt;"><b>Low carbon fuel standard – Just like California<br />
</b><a href="http://links.govdelivery.com/track?type=click&amp;enid=ZWFzPTEmbWFpbGluZ2lkPTIwMTkwMzE2LjMyNzcxNjEmbWVzc2FnZWlkPU1EQi1QUkQtQlVMLTIwMTkwMzE2LjMyNzcxNjEmZGF0YWJhc2VpZD0xMDAxJnNlcmlhbD0xNzU5NjI3MyZlbWFpbGlkPWhlYXRoZXJAd2FmcmllbmRzLm9yZyZ1c2VyaWQ9aGVhdGhlckB3YWZyaWVuZHMub3JnJmZsPSZleHRyYT1NdWx0aXZhcmlhdGVJZD0mJiY=&amp;&amp;&amp;116&amp;&amp;&amp;http://app.leg.wa.gov/billsummary?BillNumber=1110&amp;Year=2019&amp;Initiative=false" target="_blank">HB 1110</a> would direct the Department&nbsp;of Ecology to adopt standards to reduce the greenhouse gas emissions per unit of fuel energy in transportation fuels. This is something California implemented years ago, and after decades of litigation it has finally gone into effect. As a result, California's gas prices have gone up 16 cents per gallon and will continue to rise. As this&nbsp;program&nbsp;increases the cost of fuel, it results in an increase in the cost of anything that needs to be transported, which is nearly everything you purchase for your business or home.&nbsp; Washington already has some of the highest gas prices in the nation. </p>
<p style="margin-bottom: 0.0001pt;">&nbsp;</p>
<p style="margin-bottom: 0.0001pt;"><b>Transportation funding</b></p>
<p style="margin-bottom: 0.0001pt;"><a href="https://app.leg.wa.gov/billsummary?BillNumber=5971&amp;Year=2019&amp;Initiative=false">SB 5971</a> would impose a carbon tax of $15 per metric ton of carbon dioxide on gasoline, $10 per metric ton on electricity and home heating, and add a six-cent-per-gallon gas tax. The tax is structured this way because gas taxes are protected by the 18th&nbsp;Amendment of the state constitution and can be used “exclusively for highway purposes.” Carbon taxes, however, would go into the general fund and could be used for anything the legislature chooses.</p>
<p style="margin-bottom: 0.0001pt;">&nbsp;</p>
<p style="margin-bottom: 0.0001pt;"><b>Cap and Trade – also like California</b></p>
<p style="margin-bottom: 0.0001pt;"><a href="https://app.leg.wa.gov/billsummary?BillNumber=5981&amp;Year=2019&amp;Initiative=False">SB 5981</a> would create a cap-and-trade program aimed at reducing greenhouse gas emissions in Washington. If it passes, the program would be overseen by the Department of Ecology. The state would set limits on carbon dioxide emission and then sell permits to companies covered by the limits. This is the system used in California and the cost is about $15 per metric ton of carbon dioxide reduced, the same price as the carbon tax proposed by Initiative 1631 which failed on the November ballot. The cost of the permits would be passed on to consumers, just like a carbon tax.</p>
<p style="margin-bottom: 0.0001pt;">&nbsp;</p>
<p style="margin-bottom: 0.0001pt;"><b>Do farmers pay taxes? </b></p>
<p style="margin-bottom: 0.0001pt;">Of course, if you are one, you know you do, but that’s not what some Senators think.&nbsp; During a debate over a senate bill, Senator John McCoy, who represents the 38th legislative district from Everett north, said, “Ag producers in this state do not pay any taxes, none what so ever, now, they do pay some fees I give you that, but they are not being double taxed.”&nbsp; McCoy makes the fourth Democratic senator to make a similar statement during this legislative session.&nbsp; In earlier debates, Senators Saldana, Carlyle and Palumbo have made similar comments.</p>]]></description>

<p style="margin-bottom: 10.66px;">“AmericanHort is greatly appreciative of the time, effort, and manner that Chairman Roberts and Ranking Member Stabenow took to craft this important piece of legislation — as it sustains funding to initiatives and programs that are essential to the horticulture industry,” said AmericanHort Senior Vice President Craig Regelbrugge. “The committee should also be lauded for their commitment to continuing the tradition of developing a bipartisan Farm Bill.”</p>
<p style="margin-bottom: 10.66px;">Horticulture industry priorities such as the Plant Pest and Disease Management Program, National Clean Plant Network, and Specialty Crop Block Grants remain intact, with stable funding and funded at respectable levels going forward. “This is not an easy task in this budget-tightening era,” said Regelbrugge.</p>
<p style="margin-bottom: 10.66px;">The Specialty Crop Research Initiative, another key AmericanHort priority, will benefit from another $25 million in funds being available to all specialty crop industries. Additional positive developments include the creation of regional specialty crop liaisons for crop insurance, as well as the requirement for the Secretary of Agriculture to implement a strategy to accelerate the development and availability of mechanization and labor-saving technology solutions in the production of specialty crops, including nursery and floriculture crops.</p>

<p style="margin: 0in 0in 0.0001pt;"><span>TUMWATER&nbsp;</span><span>─</span><span>&nbsp;The minimum wage in Washington will increase to $11 an hour starting on Jan. 1, 2017. Since the recent election, the Department of Labor &amp; Industries has received scores of calls asking for clarity on the details of the new law.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>The new minimum wage, a result of the passage of Initiative 1433, applies to all jobs, including those in agriculture. Workers under 16 years old can be paid 85 percent of the adult minimum wage, or $9.35 per hour, in 2017. In addition to minimum wage, the initiative addresses paid sick leave.&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>Seattle, Tacoma, and the City of SeaTac have higher minimum wage rates for 2017. For employers in those areas, the local minimum wage rate will apply as long as it is higher than the state minimum.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>The new law does not change minimum wage exemptions or regulations regarding overtime pay.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>Since 1998, L&amp;I has been responsible for calculating the state’s minimum wage each September. Under Initiative 1433, the minimum wage will increase to $13.50 by 2020. L&amp;I will resume calculating the minimum wage for calendar years 2021 and beyond.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><b><span>Paid sick leave starting in 2018</span></b></p>
<p style="margin: 0in 0in 0.0001pt;"><span>Along with increasing the state minimum wage, the initiative requires employers to provide paid sick leave starting Jan. 1, 2018.</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>&nbsp;</span></p>
<p style="margin: 0in 0in 0.0001pt;"><span>Under the initiative, L&amp;I must adopt rules to enforce the new requirement, including, “…procedures for notification to employees and reporting regarding sick leave, and protecting employees from retaliation for the lawful use of sick leave…”</span></p>

<title>Please Support the H-2B Reform Bills in Senate &amp; House</title>

<p><span>On November 4, Reps. Chabot (R-OH), Goodlatte (R-VA), Harris (R-MD) and Boustany (R-LA) introduced the "Strengthen Employment and Seasonal Opportunities Now (SEASON) Act," H.R.3918.&nbsp; The introduction follows the prior week's introduction of the bipartisan "Save Our Small and Seasonal Businesses Act of 2015," (S. 2225) by Senators Tillis (R-NC), Mikulski (D-MD), Cassidy (R-LA) and Warner (D-VA).</span><br>
<span>&nbsp;</span><br>
<span>While the bills are slightly different, both the House and Senate bills would address the key issues that employers continue to face with the H-2B program.&nbsp; Both bills would exempt returning workers from the 66,000 annual cap, streamline the H-2B process, provide for a fair wage formula, allow for the use of private wage surveys and address the problems stemming from the new H-2B regulations. &nbsp;</span><br>
<span>&nbsp;</span><br>
<span>The House bill goes further in that it would essentially remove the Department of Labor (DOL) from the H-2B process.&nbsp; The Senate bill includes provisions not in the House bill that would require greatly increased coordination between the Departments of State and Homeland Security in terms of the cap count, as well as improving public transparency about the cap numbers.</span><br>
<span>&nbsp;</span><br>
<span>Now is the time to urge your two U.S. Senators, and your Representative in the House, to support these bills.&nbsp; Congress may also consider some of the H-2B fixes of these bills in a final FY2016 spending measure that must be acted on before December 11.&nbsp;</span><br>
